1. Agreement Scope:
1.1 These terms and conditions are updated as of January 26, 2024, between Milne Media Solutions, thereafter referred to as the “Photographer,” and the "Client" party, representing any and all parties engaging with Milne Media Solutions for services.
2. Property Address:
2.1 The specific location of the property for the photography services is to be provided by the Client prior to the service(s).
3. Objectives of the Shoot
3.1 The specific objectives and requirements for the media shoot must be provided by the Client to the Photographer within 12 hours of the service(s).
4. Liability:
4.1 The Photographer shall not be held liable for any damages to the property or personal belongings of the Client during the photography shoot. The Client is responsible for ensuring that the property is in suitable condition for the service(s), and the Photographer will exercise reasonable care but cannot be held responsible for unforeseen circumstances.
5. Scheduled Date & Duration:
5.1 The date and duration for the media shoot must be confirmed at least 24 hours prior to the scheduled service(s).
6. Cancellation Policies:
6.1 In the event of a cancellation made 24 hours or more before the scheduled shoot, a full refund will be issued.
6.2 Cancellations made less than 24 hours prior to the scheduled shoot will result in a $40 fee. However, exceptions will be made for uncontrollable circumstances such as adverse weather conditions or illness, in which case no fee will be applied.
7. Extensive Coverage Guarantee:
7.1 Photographer commits to capturing comprehensive video or photographic content to effectively showcase the entire property or designated project.
8. Special Requests:
8.1 Client-initiated special requests must be communicated to the Photographer within 24 hours of the intended shoot date.
9. Payment and Fees:
9.1 Invoices will be generated via Square and sent to the Client's email address upon completion of the service(s). Alternative delivery methods are available upon request.
9.2 A minimum charge of $50 applies to all photoshoots, irrespective of the quantity of photos required.
9.3 Photoshopped pictures will incur a fee of $10 per photo.
9.4 Virtual Staging services will incur a fee of $25 per photo.
9.5 Travel costs beyond the initial 40 miles will be assessed at $1 per additional mile.
9.6 A delivery service surcharge of 3.3% will be applied to each order.
10. Staging:
10.1 It's highly recommended that properties adhere to the guidelines outlined in the 'How to Properly Stage Your Property' document.
10.2 Should staging be necessary, a 25% fee will be included in the total cost of the service(s).
11. Delivery of Media:
11.1 Media will be delivered in accordance with MLS recommendations (4000x3000 pixels). Scaling adjustments, as requested by the Client, will be provided at no additional charge.
11.2 All media transfers will be facilitated through WeTransfer links.
11.3 Unless otherwise specified by MLS, all content will feature the Milne Media Solutions watermark. Special requests regarding watermarking should be communicated to the Photographer.
12. Copyright and Licensing:
12.1 Milne Media Solutions retains exclusive ownership of the media, with the Client granted a non-transferable license for usage. The Client agrees not to share or distribute the content to any third party without prior written consent from Milne Media Solutions.
12.2 Unauthorized transfer of images constitutes copyright infringement.
13. Property Release Clause:
13.1 The Client acknowledges and expressly grants Milne Media Solutions the right to use and showcase photographs of the property on Milne Media Solutions' official website and/or social media platforms for promotional and portfolio purposes. This acknowledgment signifies the Client's understanding and acceptance of all terms and conditions related to the usage of property images in promotional materials by Milne Media Solutions.
14. ENTIRE AGREEMENT: This contract, including any attachments, exhibits, or annexures referred to herein, represents the full and complete understanding between Parties concerning the subject matter herein. It supersedes all prior negotiations, understandings, and agreements between the parties, whether oral or written. No other promises, conditions, understandings, or agreements, other than those explicitly stated herein, will be considered valid or binding. Both parties acknowledge having read and understood all the terms and conditions of this contract and agree to be bound by them.
By accessing or using services provided by Milne Media Solutions, the Client acknowledges and agrees to all the terms and conditions outlined in this document.
